VgV procedures

The Public Procurement Ordinance (Vergabeverordnung, VgV) is a legal ordinance enacted by the German federal government. Since its amendment in 2016, it has served to modernise European public procurement law. This includes Directive 2014/24/EU on public procurement and Directive 2014/23/EU on concession contracts. The authorisation to issue the Public Procurement Ordinance is based on §113 and §114(2) of the German Competition Act (Gesetz gegen Wettbewerbsbeschränkungen, GWB).

The German Procurement Ordinance regulates the procedure to follow during the awarding of public contracts that are subject to the GWB and during the organisation of tenders by the public contracting entity. It does not apply for the awarding of public contracts by sector contracting entities for the purpose of sector activities,  , or the award of concessions (§1 VgV), which are provided for in separate regulations.
